Terms of Service

Summary (plain language)

Use ListingForge to generate marketing copy for properties you are authorized to market. Don't abuse the service. We can revoke access for clear ToS violations. Subscriptions auto-renew until you cancel; cancel anytime via the customer portal.

1. The service

ListingForge provides AI-assisted marketing copy and assets for real estate listings, including MLS description variants, social media posts, email blasts, open-house flyer PDFs, showing scripts, pricing rationale, and SMS templates (collectively, "Outputs"). You, the licensed real estate professional, are the publisher of record for any Output you use externally. ListingForge is a drafting tool, not a publishing service.

2. Acceptable use

By using ListingForge you represent and warrant that:

  • You have authority to market the property. You must hold a current real estate license (or be operating under direct supervision of a licensed broker) and have a signed listing agreement, buyer representation agreement, or written permission from the property owner before generating Outputs for that property.
  • Fair Housing compliance. You will not submit prompts describing protected classes (race, color, religion, sex, national origin, disability, familial status) or request copy that steers buyers or renters in violation of the Fair Housing Act, the Equal Credit Opportunity Act, or the NAR Code of Ethics. Each generation returns a fair-housing watch-out list; you agree to review it before publishing.
  • No automated scraping. You will not use automated scripts, bots, or programs to bulk-generate Outputs for resale or redistribution outside your own licensed practice.
  • No reverse-engineering. You will not attempt to extract, copy, or reverse-engineer the prompts, model configurations, or proprietary logic underlying the service.
  • One account per individual. Each account is for a single licensed agent or brokerage seat. Creating multiple accounts to circumvent plan limits is grounds for immediate termination of all associated accounts.

3. AI-generated content disclaimer

All Outputs are AI-generated drafts. ListingForge does not warrant that Outputs are accurate, complete, legally compliant, or suitable for any particular MLS or jurisdiction. AI language models can produce inaccurate property details, metric errors, or phrasing that requires correction. You are solely responsible for:

  • Verifying all factual claims (square footage, school districts, taxes, HOA).
  • Reviewing fair-housing watch-outs returned with each generation and editing accordingly.
  • Ensuring compliance with applicable MLS rules, brokerage policies, and law.
  • Disclosing to clients that initial copy was AI-assisted if required by your brokerage or applicable regulations.

4. Subscription terms

Paid plans are billed on a monthly recurring basis. Your subscription renews automatically at the end of each billing period unless you cancel beforehand. You may upgrade, downgrade, or cancel your plan at any time via the Stripe customer portal, accessible from your dashboard billing page. Cancellation takes effect at the end of your current paid period — you retain access through the period you have already paid for. We do not issue refunds for partial billing periods except where required by applicable law.

5. Free tier and plan limits

The free plan permits up to 3 listing generations per rolling 30-day window. Paid plan limits are shown on the billing page of your dashboard. Quota resets are tracked atomically; creating multiple accounts to evade limits is a material breach of these Terms and grounds for termination of all associated accounts without refund. ListingForge reserves the right to modify plan limits with reasonable notice to existing subscribers.

6. Limitation of liability

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent permitted by applicable law, ListingForge's total cumulative liability to you for any claims arising out of or related to these Terms or the service is capped at the total amounts you paid to ListingForge in the twelve months immediately preceding the claim. ListingForge is not liable for any indirect, incidental, consequential, or punitive damages, including losses arising from your publication or use of AI-generated content after your own review.

7. Termination

You may delete your account at any time from the dashboard. Upon deletion, all your data is removed within 30 days per our Privacy Policy. ListingForge reserves the right to suspend or terminate your account immediately for: material breach of these Terms, abuse of the service or underlying APIs, non-payment of subscription fees, fraudulent activity, or behaviour that may expose ListingForge or its users to legal liability. Where reasonably practicable, we will provide advance notice and an opportunity to cure before termination.

8. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the service that cannot be resolved informally shall be submitted to binding arbitration administered under the rules of the American Arbitration Association in Delaware, except that either party may bring claims eligible for small-claims court in the jurisdiction where you reside.

9. Changes to these Terms

We will notify you by email at the address associated with your account before any material changes to these Terms take effect. Your continued use of the service after the notice period constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you may cancel your account before they take effect.
